Feb. 7, 2006 "” A wild New Year's Eve two years ago has landed a Georgia teen in prison for 10 years on charges of child molestation in a case that has state legislators reworking the strict law that put him behind bars.

Genarlow Wilson and a group of friends had the kind of bash no parent would want their teenager to attend. Crime scene investigators combing the room in a Days Inn in the small town of Douglasville, Ga., found evidence of drinking, as well as condoms and wrappers littered all over. Plus, there was a video camera.

In a portion of a tape obtained by "Primetime," Wilson, then 17 and an honor student and star athlete who was homecoming king, is seen having intercourse with a 17-year-old girl, who was seen earlier on the bathroom floor. During the sex act, she appears to be sleepy or intoxicated but never asks Wilson to stop. Later on in the tape, she is seen being pulled off the bed.

Other portions of the tape show a second girl, who was 15 and later said she did not drink that night. She was recorded having oral sex with several boys in succession, including Wilson.

The following morning, Wilson got a phone call that would change his life. He learned from a friend that the 17-year-old had gone to the police to report that she'd been raped.

"I was, like, 'What? When was this happening? Did this happen at the same party I was at?'" Wilson said. "It was shocking to me."

A Decade in Prison

Authorities believed the 17-year-old alleged rape victim and said she was too intoxicated to consent to any sexual acts, which is what Georgia law requires, otherwise these acts can be considered rape.

Six boys, including Wilson, were arrested on various charges, including rape. District Attorney David McDade said the videotape was critical to his case. "There is no doubt that without the videotape we would have to be relying on the statements of these young people, and that would have been a more difficult prosecution," he said.

I have no problem wth this (the jail sentance) IF the parents on BOTH sides are also thrown in jal for the same amount of time.

A drug rape, it seems?

Shouldn't the title of this thread be "10 Years for Oral Sex with a Minor"? He was acquitted of raping the girl on the bed but got nailed for the BJ from the 15 year old.

Damn, I thought this was going to be about a rainbow party..

I've never understood how if both parties are intoxicated it can be classified as rape. (in a non-forceful instance I mean)

Yeah but, according to the report:

And previously in the tape, she was on the bathroom floor. So a guy who's had a six pack, is drunk, could absolutely take advantage of that kind of situation.

Sounds like she was just lying there, he jumps on, then when he's finished, they carry her off the bed...Regardless, the jury found in his favor, no idea why I'm arguing this.
Just having flashbacks from college to having to physically restrain some f*cktard who was trying to get in bed with a near-passed out female friend.

I agree that if two hammered people have some wild kinky sex, have a blast, then after regretting it the next day, neither should be able to claim rape the next morning.

I have to agree, two people doing something stupid while they're both drunk where no one is violently or emotionally attacked isn't rape to me, it's two people doing some thing stupid. Drunk guy getting on top of passed out girl is rape. People do stupid things at parties and consent to things they normally wouldn't. Deciding later that she shouldn't have had sex doesn't mean it's rape, it means she made a bad decision, end of story.

That said, I haven't seen the tape, so I can't comment on this instance in particular, but a 17 year old and a 15 year old getting it on... is that even stat. rape? Both of them are underage. True, he was older, but still. If it is, I know a lot of freshman girls from high school who could claim rape on the junior and senior guys who were constantly looking for action. Not saying it's "right" or anything, but I was under the impression it wasn't illegal either.

Yes. While I know a number of states go on a system like, "If person A and person B are within so many years, and both minors" then it's not stat. rape, but GA will give 10-15 years if the person is under 16. So if she was one year older, this guy would have been acquitted on both accounts.

Happy Steak & BJ Day! I'll have to remember to put it on my calendar next year, I didn't warn those involved of it's significance.

I have a friend whose girlfriend was technically undersage for a year. He was 18, she was 15. It was a large age difference, when you're that young, but whatever. If getting a single BJ from a 15 year-old is 10 years, this guy's got ten consecutive life sentences coming his way. I really have nothing to say on this point, other than that I hadn't known that oral sex could constitute rape. Huh. Learn something new every day.

This guy will have his sentence reduced, if that law does get changed. Whatever it gets changed to, his sentence will be retroactively changed to that.

What's really sad about this, is that in GA the minimum sentence is 10 years, and in Texas, this would be perfectly legal [minimum age of consent is 14yrs old, and the other person must be within 3yrs age difference].

Most likely. I seriously doubt this guy will get more than a year or two of jail time (if not time served), with a butt load of community service, parole, and some sort of fine. Not a great thing to be slapped with at 17, but better than:

Not to mention the stigma of a sex offender for the rest of his life.

It would seem to me that the guy who gets butt-banged in the end did so because he was drunk and horny, but I think the issue in this teenage case was that one or more girls were drunk and impaired. Could be wrong, but it looks like it is being used as a diminished capacity issue.

On a separate note, if a man were to get drunk on drinks bought by a female stranger and wake up in the woman's bed having no recollection of how he got there, would he have a case to make that he was raped?

Depends. If there was a drug in the drinks, that's malicious poisoning, as well as rape. If he just got drunk, and he's over 21, then not really. It's just labelled a bad decision on his part if he didn't want to participate, but was too impared to make the call. There would be no case since there's no proof he wasn't willing, and by that morning, a good deal of the alcohol would be out of his system. The only way he could press charges would be if the woman had something like AIDS. That could be considered willful endangerment. Not sure if it would hold up in court, but I'm pretty sure he could file it against her.

Actually the moral of the story is not to videotape such acts. But that is above and beyond these idiots. They wanted to be on COPS and they got it.

I will never understand teenager's need to tape every act that they know adults will look disfavorably on. Hey guys, it's called not giving the prosecution more evidence than they already needed... duuuuuuuuh. Someone needs to show these boys a few episodes of CSI.
