I wouldn't even debate if it is a politically motivated act (their most likely claim) the question is is it legal? Because motivation really doesn't enter into whether or not it is legal. If it is a legal subpoena and they refuse they are breaking the law. And if they want to argue that sometimes it is ok to break the law - fine we have millions of cases that need to be looked at to see if it was Ok in that instance.

Mostly because the FDA dropped the ball with Abbott Nutrition going back to at least 2019. Abbott makes about a third of the powered baby formula in the country and was ordered to stop production earlier this year when contamination of their formula killed to infants.

Turns out Abbott had "overlooked" some massive problems at the facility that manufactured the formula and opted to cheap out on maintenance and sanitation while straight up lying to the FDA about their records and compliance. The FDA accepted Abbott's BS during a 2019 audit and slow rolled their response to a whistleblower who submitted documentation to the FDA for these and other issues in October 2021.

Of course Abbott's senior executives deserve the lion's share of blame because of their gross mismanagement of their Sturgis production facility and that they chose to spend over $5 billion buying back stock over the past couple of years instead of using that money to fix the manufacturing issues they knew about.

Nationally the out-of-stock rate for baby formula is 40%, with some states at 50%+.

So the actual answer is "you're f*cked because Abbott executives were greedy, incompetent bastards who really wanted their bonuses." But if the Biden administration said that then they'd be accused (even harder) of being communists/socialists who hate capitalism.

But most Americans can't handle that answer just like they can't handle the reality that Biden doesn't control gas prices and they refuse to put two and two together and assign the blame to all the energy companies who are making record profits.

Don't worry. Trump and the GQP will fix the baby formula problem by imposing tariffs on China and subsidizing Abbott executives.

Here's his statement that amplifies the current right wing message about the formula shortage--that dirty immigrant babies are getting formula before good, White, Christian American babies--without acknowledging the fact the immigrant babies are in detention centers and only complete monsters would purposefully starve children who are the wards of the US government.

Sadly, several other Republican politicians have echoed the idea that we should starve immigrant detainees.

The US version of the Great Replacement theory says that The Jews (or the Rothchilds, or Globalists) are trying to replace white people with people from South America and the Middle East. Obviously jewish people are not considered as white people in this context (ref. Schroedinger's White People).
