While Thompson is still in the thick of his Bully battle, he made time today to fire off a cease and desist order to Midway Games. He wants the publisher to stop distributing Mortal Kombat: Armageddon, but contrary to what one might expect, he didn't cite the game's over-the-top violence as a reason to stop selling it.
"It has today come to my attention that the newly recently [sic] Mortal Kombat: Armageddon [b]contains an unauthorized commercial exploitation of my name, photograph, image, and likeness within the game[/b]," Thompson wrote in an e-mail addressed to Midway president and CEO David Zucker and carbon-copied to several news outlets. "You are commanded to cease and desist immediately from the distribution of this game because of this unauthorized, illegal content." (Emphasis in original.)

Snort! Reading the article, it isn't even a real character, just something that they created using the fighter customization options. And yelling at a judge... wow, Thompson really is crazy. He was very lucky to stand before a judge who didn't have him thrown into a cell for some cooldown time.
Everything can be debated, but that doesn't necessarily mean it's debatable.

And let us not forget that was an out-of-court settlement, so we don't have a precedent on the legal books for that yet so far.
Hopefully it goes to court and the court sides with Midway. This would at least set a legal precedent so lawyers can't hold these kinds of threats over game companies' heads due to user-created content.
Can I get a quick synopsis on what happened with that case? Not familiar with it.

Misappropriation of likeness is a tort in some states. In Minnesota there is a case about a company that converted some guy's face into a baby image and made a line of porcelain baby dolls all with the guy's face. Really bizarre. I forget how torts like that interact with First Amendment free speech issues, but I think it's safe to say that Jack has no case here.

Marvel complained that you could use the CoH character creator to make characters that looked identical to their IPs. CoH responded by removing some key items from the creator, if memory serves.
